STAGEit Terms of Use

These Terms of Use apply when you access or use STAGEit, provided by Spatial Creative Ltd.
We have tried to keep these terms clear, fair and straightforward. They explain how you may use STAGEit, what you can expect from Spatial Creative Ltd, and what we expect from you.
By creating an account, purchasing a subscription or using STAGEit, you agree to these Terms of Use.
1. About STAGEit
STAGEit is an immersive presentation platform that allows users to create, manage and deliver interactive spatial presentations and experiences using supported devices and platforms.
STAGEit includes the STAGEit Creator, Presenter and Host applications, together with associated account, licensing and subscription services provided by Spatial Creative Ltd.
Features available to you will depend on your subscription plan and the devices and platforms you use.
2. Your Account
Some STAGEit features require a STAGEit account.
You are responsible for providing accurate information, keeping your account details secure and for activity carried out through your account.
Please let Spatial Creative Ltd know promptly if you believe somebody else has gained unauthorised access to your account.
Accounts are personal to the individual or organisation to which they are issued and should not be transferred or shared in a way that circumvents the limits of your subscription.
3. Plans and Subscriptions
STAGEit may be available through free and paid subscription plans, including plans intended for individual creators, presenters, teams and enterprise customers.
Each plan provides access to a particular combination of STAGEit applications, features, presentation limits and device entitlements.
Details of the features and limits included with each plan will be shown when you subscribe or provided as part of your agreement with Spatial Creative Ltd.
Spatial Creative Ltd may change the features or limits associated with its plans as STAGEit develops. Where a material change affects an existing paid subscription, we will provide reasonable notice where practical.
4. Enterprise Customers
Spatial Creative Ltd may offer bespoke STAGEit licences and commercial arrangements to businesses and other organisations.
Enterprise arrangements may include different device limits, deployment options, support, training, integrations or other services agreed directly with the customer.
Where an Enterprise agreement has been entered into with Spatial Creative Ltd, its specific terms will take precedence over these Terms of Use where there is any conflict.
5. Payments and Renewals
Paid STAGEit subscriptions may be purchased through Apple or another authorised platform, or directly from Spatial Creative Ltd where available.
Where a subscription is purchased through Apple or another platform, payment, billing, renewal, cancellation and refunds are also subject to that platform’s applicable terms.
Where a subscription is purchased directly from Spatial Creative Ltd, the pricing and payment terms provided at the time of purchase will apply.
Subscriptions may renew automatically unless cancelled before the relevant renewal date.
Prices may change from time to time. Any change to the price of an existing subscription will take effect in accordance with the applicable purchase platform’s terms or following reasonable notice from Spatial Creative Ltd for subscriptions purchased directly.
6. Cancelling a Subscription
You may cancel a subscription through the platform through which it was purchased or through the account management options provided by Spatial Creative Ltd, where applicable.
Cancellation stops future renewals but does not normally provide a refund for a subscription period that has already started, except where required by law or under the terms of the platform through which the subscription was purchased.
You can continue to use the features included in your subscription until the end of the paid subscription period unless otherwise stated.
7. Licence to Use STAGEit
While you have a valid entitlement to use STAGEit, Spatial Creative Ltd grants you a limited, non-exclusive, non-transferable licence to use the software and associated services for their intended purpose.
You do not acquire ownership of STAGEit or any of its underlying software, technology or intellectual property.
You must not copy, modify, reverse engineer, redistribute, resell, sublicense or attempt to gain unauthorised access to STAGEit or its underlying systems, except where expressly permitted by Spatial Creative Ltd or where the law expressly allows you to do so.
You must not attempt to circumvent subscription, licensing, presentation or device limits.
8. Your Presentations and Content
Your presentations and content remain yours.
STAGEit allows you to create and use presentations containing content such as text, images, video, audio, 3D models, animations and other materials.
Spatial Creative Ltd does not claim ownership of content simply because it is created, imported, viewed or presented using STAGEit.
You are responsible for the content you use with STAGEit and for ensuring that you have the necessary rights, licences and permissions to use and present it.
9. Where Your Content is Stored
STAGEit does not upload or store your presentation content on Spatial Creative Ltd’s cloud servers.
Your presentations, including any associated images, videos, audio, 3D models and other content, remain stored on and under the control of your devices.
Our online services only store the information required to manage your STAGEit account, subscription, licences and device entitlements.
If Spatial Creative Ltd introduces optional cloud-based content services in the future, these will be clearly identified as separate features, and we will explain what information is stored and how it is handled before you choose to use them.
10. Devices and STAGEit Host
Different STAGEit plans may allow presentations to be used on, or delivered to, different numbers of devices.
Where STAGEit Host functionality is included in your plan, the number of connected devices you may manage will depend on the relevant subscription or Enterprise agreement.
Device entitlements and licensing may be managed through your STAGEit account.
Spatial Creative Ltd may use reasonable technical measures to ensure that licences and subscriptions are used within the limits of the relevant plan.
11. Acceptable Use
STAGEit must be used responsibly and lawfully.
You must not use STAGEit to:
- break the law or encourage unlawful activity;
- infringe another person’s intellectual property, privacy or other rights;
- create, distribute or introduce malware or harmful software;
- interfere with or compromise STAGEit’s systems, services or security;
- gain or attempt to gain unauthorised access to accounts, systems or data;
- circumvent licensing, subscription or device restrictions; or
- use STAGEit in a way that materially disrupts its operation for other users.
Spatial Creative Ltd may restrict or suspend access where we reasonably believe STAGEit is being misused or these Terms of Use have been seriously breached.
12. AI Features
STAGEit may include features that use artificial intelligence or third-party AI services.
AI-generated content may be inaccurate, incomplete or unsuitable for a particular purpose. You are responsible for reviewing AI-generated outputs before relying on, presenting or publishing them.
Where an AI feature requires information to be sent to a third-party AI provider in order to perform the requested function, Spatial Creative Ltd will make this clear where appropriate.
Use of AI features may also be subject to additional terms or usage limits.
13. Updates and Development
Spatial Creative Ltd will continue to develop STAGEit and may add, modify or remove features over time.
Updates may be required to maintain compatibility with Apple Vision Pro or other devices, operating systems, software and third-party technologies.
Spatial Creative Ltd may stop supporting older versions of STAGEit where maintaining compatibility is no longer practical or commercially reasonable.
Where possible, we will avoid making changes that unnecessarily disrupt how customers use STAGEit.
14. Availability
Spatial Creative Ltd aims to make STAGEit reliable and available, but no software can be guaranteed to operate without interruption or error.
Availability and functionality may occasionally be affected by maintenance, software updates, device or operating system changes, third-party services, internet or local network connectivity, hardware issues or circumstances outside our reasonable control.
Spatial Creative Ltd does not guarantee that STAGEit will always be available, uninterrupted or compatible with every device, operating system or configuration.
15. Third-Party Products and Services
STAGEit may operate with or rely upon third-party hardware, operating systems, software, content, platforms or services.
These products and services may be subject to their own terms, licences and privacy policies.
Spatial Creative Ltd is not responsible for the availability, performance or continued operation of third-party products or services that are outside our control.
16. Intellectual Property
STAGEit, including its applications, software, technology, user interface, design, branding and associated intellectual property, belongs to Spatial Creative Ltd or its licensors.
Nothing in these Terms of Use transfers ownership of STAGEit or its underlying intellectual property to you.
Your own presentation content remains yours, as described in Section 8.
Third-party content remains the property of its respective owners and is subject to any applicable licence terms.
17. Feedback
We welcome feedback, suggestions and ideas about STAGEit.
If you choose to provide feedback, Spatial Creative Ltd may use it to improve and develop STAGEit without restriction or obligation to compensate you.
This does not give Spatial Creative Ltd any rights over your presentations, confidential information or other content.
18. Suspension and Termination
You can stop using STAGEit at any time.
Spatial Creative Ltd may suspend or terminate access where you seriously breach these Terms of Use, misuse STAGEit, fail to pay applicable fees, attempt to circumvent licensing restrictions, or where continuing to provide access would create a legal or security risk.
Where reasonably possible, we will give you an opportunity to resolve the issue before suspending or terminating your access.
When a paid subscription ends, access to features associated with that subscription may end or revert to the features available under another applicable plan.
Ending a subscription or account does not transfer or remove ownership of your presentation content, which remains under your control on your devices.
19. Our Responsibility
Spatial Creative Ltd will provide STAGEit with reasonable care and skill.
STAGEit relies on hardware, operating systems, networks and other technologies, some of which are outside the control of Spatial Creative Ltd. We therefore cannot promise that STAGEit will always operate without interruption or error.
To the fullest extent permitted by law, Spatial Creative Ltd will not be responsible for indirect or consequential losses, loss of profit, loss of revenue, loss of business, loss of anticipated savings or losses caused by circumstances outside our reasonable control.
Spatial Creative Ltd will not be responsible for loss of presentation content stored on your devices. You are responsible for maintaining appropriate copies and backups of content that is important to you.
For business users, to the fullest extent permitted by law, Spatial Creative Ltd’s total liability arising from or relating to STAGEit will not exceed the amount paid by you to Spatial Creative Ltd for STAGEit during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms of Use excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
20. Business and Consumer Users
STAGEit may be used by both businesses and individuals.
If you use STAGEit on behalf of a business or organisation, you confirm that you have authority to accept these Terms of Use on its behalf.
If you are using STAGEit as a consumer, nothing in these Terms of Use affects any rights you have under applicable consumer law.
Where a provision of these terms cannot lawfully apply to a consumer, your statutory rights will take precedence.
21. Privacy
Spatial Creative Ltd’s Privacy Policy explains how we collect, use and protect personal information associated with STAGEit accounts and services.
Presentation content remains stored on your devices and is not stored on Spatial Creative Ltd’s cloud servers, as described in Section 9.
22. Changes to These Terms
Spatial Creative Ltd may update these Terms of Use as STAGEit develops or where legal, regulatory or commercial requirements change.
If we make a material change affecting existing users, we will provide reasonable notice where appropriate.
The updated Terms of Use will apply from the date stated in the updated version, subject to any rights you may have under applicable law.
23. Governing Law
These Terms of Use are governed by the laws of England and Wales.
If you are using STAGEit as a business, the courts of England and Wales will have exclusive jurisdiction over disputes relating to these terms.
If you are using STAGEit as a consumer, you may also have rights to bring proceedings in the courts applicable to where you live under applicable consumer law.
